TUPE

    What is TUPE?

    TUPE is an acronym for the Transfer of Undertakings (Protection of Employment) regulations 2006.  The purpose of TUPE is to protect the employment rights, terms and conditions of service and continuous service of staff whose employer changes as the result of a Transfer of Undertaking.

    There are 2 different TUPE situations that might apply.  The first is in relation to staff who TUPE transfer out of an NHS Board to another employer and the second is where staff from another organisation transfer into an NHS Board.
